TERMS OF SERVICE (U.S. ONLY)

These Terms of Service (the “Terms”) govern your access to and use of the website and online store operated by JiYue Express LLC d/b/a JYPOD (“JYPOD,” “we,” “us,” or “our”), including all related information, content, features, tools, products, and services (collectively, the “Services”).

Our store is hosted on Shopify, which provides the e-commerce platform that enables us to offer the Services.

By visiting, browsing, interacting with, or purchasing from our Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. ELIGIBILITY AND ACCOUNT

Age requirement. You must be at least the age of majority in your state of residence to use the Services.
Account information. You may be required to provide information such as your email address and billing/shipping details. You represent that all information you provide is accurate, current, and complete.
Account security. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
No transfer. You may not transfer, sell, assign, or license your account to any other person.

2. PRODUCTS (T-SHIRTS & HOODIES) AND PRODUCT INFORMATION

Product images & colors. We make reasonable efforts to display product photos and colors accurately, but the appearance may vary by device/screen settings and lighting.
Sizing & fit. Fit can vary by style and personal preference. Please refer to the size chart on the product page before ordering. We do not guarantee that any item will fit exactly as expected.
Material & production variation. Minor variations in color, texture, stitching, print placement, and measurements may occur due to manufacturing processes and are not considered defects.
Care & shrinkage. Follow care instructions on the product page or garment label. Improper washing/drying may cause shrinkage or damage, which is not considered a defect.
Changes/availability. We may update product descriptions, pricing, and availability, or discontinue products at any time without notice, to the extent permitted by law.
Purchase limits. We may limit quantities purchased per person, per household, or per order.

3. ORDERS, ACCEPTANCE, AND CANCELLATIONS

Offer to purchase. When you place an order, you are making an offer to purchase.
Order acceptance. An order is not accepted until we confirm acceptance and your payment is authorized and processed.
Cancellations/changes. Once an order is accepted, we may be unable to cancel or modify it.
Refusal/cancellation. We reserve the right to refuse, cancel, or limit any order at our discretion (including suspected fraud, unauthorized transactions, or inventory issues). If we cancel an order, we will attempt to notify you using the contact information provided at checkout.
Personal use only. Purchases are intended for personal/household use and not for commercial resale or export.

4. PRICES, TAXES, AND BILLING

Pricing. Prices and promotions may change without notice. The price shown at checkout at the time you place the order is the price you will pay.
Taxes and fees. Prices do not include shipping/handling or applicable taxes unless stated otherwise. These will be shown at checkout.
Payment authorization. You represent that you are authorized to use the payment method provided. You authorize us (and our payment processors) to charge your payment method for the order total.

5. SHIPPING, DELIVERY, AND RISK OF LOSS (UNITED STATES ONLY)

U.S.-only customers and shipping. Our Services and sales are intended for customers in the United States, and we ship only to U.S. addresses. We may cancel orders that request shipment outside the U.S. or appear to be placed from outside the U.S.
Delivery estimates. Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers or events outside our control.
Risk of loss. Title and risk of loss pass to you when we transfer the package to the carrier, to the extent permitted by applicable law.
Accurate address required. You are responsible for providing a complete and accurate shipping address. We are not responsible for loss due to an incorrect or incomplete address provided by you.

6. RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

7. INTELLECTUAL PROPERTY

Ownership. The Services and all content (including text, graphics, logos, images, and design) are owned by or licensed to JiYue Express LLC and are protected by intellectual property laws.
Limited license. You may use the Services for personal, non-commercial use only.
Restrictions. You may not copy, reproduce, distribute, modify, create derivative works from, or exploit any portion of the Services without our prior written consent, except as permitted by law.
Trademarks. “JYPOD” and related marks are trademarks of JYPOD. Shopify and related marks are trademarks of Shopify. All other trademarks belong to their respective owners.

8. THIRD-PARTY TOOLS AND LINKS

We may provide access to third-party tools or links. We do not control and are not responsible for third-party content, products, or services. Your use of third-party tools/sites is at your own risk and subject to their terms.

9. PRIVACY

Our collection and use of personal information is described in our Privacy Policy. Because our store is hosted on Shopify, Shopify may also process certain information as part of providing the platform.

10. FEEDBACK AND SUBMISSIONS

If you submit reviews, suggestions, or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display that Feedback for any lawful purpose, including marketing. You represent that your Feedback does not violate any third-party rights or applicable law.

11. ERRORS AND OMISSIONS

We may correct errors, inaccuracies, or omissions (including pricing or availability) and may cancel orders if information is inaccurate, to the extent permitted by law.

12. PROHIBITED USES

You agree not to misuse the Services. You may not, directly or indirectly:

violate any applicable law or regulation;
infringe intellectual property or other rights;
harass, abuse, defame, or harm others;
submit false or misleading information;
transmit malware/viruses or harmful code;
scrape, crawl, or use automated methods to access the Services without permission;
attempt unauthorized access or interfere with security features.

We may suspend or terminate access for violations.

13. TERMINATION

We may suspend or terminate your access to the Services at any time for any reason, including suspected fraud or violation of these Terms. Provisions that by their nature should survive termination will survive.

14. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

15. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JYPOD (INCLUDING ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND SERVICE PROVIDERS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS.

IN NO EVENT SHALL JYPOD’S TOTAL LIABILITY FOR ANY CLAIM EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM, OR US$100, WHICHEVER IS GREATER, UNLESS APPLICABLE LAW REQUIRES OTHERWISE.

16. INDEMNIFICATION

You agree to indemnify and hold harmless JYPOD and Shopify (and their affiliates, officers, directors, employees, and agents) from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party rights.

17. SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in full force and effect.

18. ENTIRE AGREEMENT; WAIVER

These Terms, together with policies referenced (including the Privacy Policy and Return & Refund Policy), constitute the entire agreement between you and us regarding the Services. Our failure to enforce any right is not a waiver of that right.

19. ASSIGNMENT

You may not assign these Terms without our prior written consent. We may assign these Terms as permitted by law, including in connection with a merger, acquisition, or sale of assets.

20. GOVERNING LAW; VENUE

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. You agree that any dispute will be brought in the state or federal courts located in California, and you consent to jurisdiction and venue there.

21. CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on this page. Changes take effect when posted (or as otherwise required by law). Your continued use of the Services after changes become effective constitutes acceptance.
